Once you engage the services of Datom Technologies Ltd hereafter referred to as Hackney Digital, you confirm that you have read and understood our terms and conditions and around bound by them as follows. Definitions: ‘CLIENT’ A person or company engaging the services of Hackney Digital. Hackney Digital An SEO (search engine optimisation) provider offering extensive services, including hosting, web design, PPC (pay per click) and marketing. General Any order-verbal or written-is a binding contract between the client and Hackney Digital. This includes by phone, email or chat. Hackney Digital cannot accept responsibility for losses incurred due to any website malfunction. We ensure all scripts and programs are error-free before use. Hackney Digital retains property rights for graphics, coding and website until all accounts are paid in full. You may not commercially reproduce or resell any of our scripts, software, articles or applications without express written permission from us. Hackney Digital takes no responsibility for copyright infringements in materials you provide. We refuse copyright material unless proof of permission is seen. The Client must provide us with passwords and logins to complete work. Hackney Digital is not liable if you fail to meet such deadlines and requirements. Hackney Digital is not liable for disputes between the site owner and clients Hackney Digital is not liable for work carried out on behalf of the clients Hackney Digital is not liable for costs of pay-per-click advertising campaigns on platforms such as Facebook or Google. Hackney Digital is not liable for any accounts that may get hacked or comprised. This includes our own agency account. If this may occur, the party who has been subject to the hack will need to resolve the issue directly with the advertising provider. Furthermore, Hackney Digital will not be held responsible for any losses that may have occurred due to this. Hackney Digital not liable for the site’s content. The Client should review anything written and published by Hackney Digital within seven days of agreed publication. Disclaimers and limitations on liability Hackney Digital does not guarantee results or ROI. Hackney Digital does not ensure that increasing rankings correlates to increasing sales or business. Hackney Digital is not responsible for ISP issues or failures. Hackney Digital is not responsible for acts or causes beyond their control, including but not limited to: acts of God, strikes, lockouts, communications line or equipment failures, power failures, earthquakes, or other disasters. Hackney Digital used at your sole risk; we expressly disclaim all warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose or non-infringement. Hackney Digital has no liability in the event of hacking, security breach, piracy or any other attack or data corruption. Compatibility All sites and apps are designed to function correctly on the server and when viewed with most mainstream internet browsers. We cannot guarantee other third-party browsers. Website Hosting Recommended third-party specialists carry out hosting. We make no guarantees or liability for these services, including downtime, unavailability, loss of sales, etc. We do not host any material containing illegal, offensive or controversial media. A website causing server speed issues or instability will be removed. It is our right to defend hosting stability for all clients. Ensure you discuss high traffic or abnormal usage periods with us, so we can ascertain the effect this might have. Payment of Accounts Invoices are due within seven days of the invoice date. Failure to make prompt payment can lead to work being stopped or removed. New accounts are required to pay one month in advance before work commences. We will take legal action if needs be to recover the monies owed. Additional Services/Fair Use Policy Occasionally we need to make changes to your website to improve the current campaign. These are agreed upon in advance. If significant changes are required, we will outline and advise you to work with your web developer to implement them. We may occasionally recommend further chargeable services from ourselves or a third party and will be quoted for and agreed upon in advance. Cancellation We operate a 28-day cancellation policy, which must be requested in writing, and any outstanding invoice must be paid. Complaints If you are unhappy with any service we provide and feel that this cannot be resolved in conversation, please submit your case in writing. We will answer all complaints within 14 days and take every issue seriously. Refunds Hackney Digital does not provide any refunds.
